Nationwide Lawyer for Denied Disability Insurance Claim for Complete Disability
Many people who become injured or too ill to continue working are surprised to learn that their long-term disability insurance provider does not think that their claim qualifies for complete disability. Under the provisions of the contract — and that is exactly what an insurance policy is — the disability insurance company may try to claim the right to determine what qualifies for full payment.
In recent years, there has been a sharp spike in denied claims for full disability benefits, even for clients who have suffered serious injuries or diagnosis for conditions that will no longer allow them to work. Some private insurance providers will deny claims for disabilities that even the federal Social Security Disability Insurance (SSDI) office will approve.
A Working Definition of Complete Disability
It is important to remember that "complete" disability is not the same as "permanent" disability. For private disability insurance claims, complete disability may be defined as any physical, emotional or mental health condition that makes it impossible for the claimant to perform regularly assigned job tasks at his or her regular place of business or employment. This does not mean the claimant is physically unable to perform any work. It means the claimant is temporarily or permanently unable to earn wages, salary or income from his or her usual means of employment.
Disability insurance providers are often quick to allow for partial disability payments, if they determine that the injury or illness does not prevent the claimant from working in a diminished capacity. Unfortunately, employers do not always make allowances for reduced workload and the injured or disabled party is left without work options. In effect, a partial disability often amounts to the same end result as complete disability.
